Terms of Service

1. Definitions

In these Terms of Service, the following terms have the meaning indicated:

• "Tabiquo", "we", "us": refers to Andreality S.L., operator of the Tabiquo platform.
• "Service": the Tabiquo platform, including the web application, APIs, and all related services.
• "User", "you": any person who accesses or uses the Service.
• "Account": the registered profile that allows you to access the Service features.
• "User Content": any document, image, data or material that you upload or create on the platform.
• "Subscription": the payment plan you chose to access certain Service features.

2. Acceptance of Terms

By creating an account, accessing or using Tabiquo, you confirm that:

• You have read, understood and accept these Terms of Service
• You are at least 18 years old
• You have legal capacity to enter into a binding contract
• If acting on behalf of a company, you have authority to bind it to these terms

If you do not agree with these terms, you must not use the Service.

3. Registration and Account

3.1. Account Creation

To use Tabiquo, you must create an account providing:

• Accurate and up-to-date information
• A valid email address
• A secure password

3.2. Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We will not be liable for losses arising from unauthorized use of your account if you have not notified us.

4. Plans, Pricing and Payments

4.1. Available Plans

Tabiquo offers different subscription plans:

• Free trial: full access to the platform for the trial period shown at registration, with no payment details required. When it ends, your data is kept and access resumes when a plan is activated
• Paid Plans: monthly or annual billing with different levels based on number of projects, storage, users and included capacity
• Enterprise Plan: customized solutions with dedicated support, guaranteed SLA and customization options

Specific limits for each plan are detailed on our pricing page and may be modified with prior notice.

4.2. Billing and Renewal

• Billing: we bill by invoice at the start of each billing period. The subscription continues period to period until you tell us to cancel
• Billing period: monthly, or annual with the discount published on the pricing page
• Plan changes: if you change plans, the new price applies from the next billing period unless we agree otherwise with you
• Taxes: prices do not include VAT or other applicable taxes, which will be added based on your tax location
• Currency: transactions are made in EUR (euros) for customers in the European Union
• Invoices: you will receive electronic invoices compliant with tax regulations by email

4.3. Payment Methods

We accept the following payment methods:

• Bank transfer (SEPA) against invoice
• Other methods agreed with us in writing
• No credit card is required at any point

We do not collect or store payment card data. Payment is made against the invoice we send you.

4.4. Non-Payment

If an invoice remains unpaid:

• We will contact you by email to resolve it
• We will agree a reasonable additional period for payment
• If the invoice remains unpaid after that period, access may be suspended with prior notice
• Your data is retained and remains exportable in accordance with section 11

Keep your billing contact details up to date to avoid service interruptions.

4.5. Cancellation and Refunds

• Cancellation: you can cancel your subscription at any time by writing to [email protected]. Cancellation will be effective at the end of the current billing period
• Post-cancellation access: after cancellation, you maintain full access until the end of the paid period
• Refund policy: we do not offer refunds for periods already invoiced; the free trial exists so you can evaluate the platform fully before paying
• Right of withdrawal (EU): consumers in the EU have the right to withdraw within 14 days of contracting. This statutory right is independent of the free trial

4.6. Price Changes

We reserve the right to modify our prices at any time. Changes will be communicated at least 30 days in advance and will not affect your current billing period.

5. Acceptable Use and Prohibited Conduct

5.1. Permitted Uses

Tabiquo is designed for legitimate professional use in construction, architecture and engineering project management. You may use the Service to:

• Manage professional projects for your company or clients
• Store and share legitimate technical documentation
• Collaborate with your team, clients and authorized collaborators
• Generate project reports and analyses

5.2. Prohibited Conduct

You agree NOT to use the Service to:

Violations may result in:

• Formal warning for first minor offense
• Temporary account suspension
• Immediate termination without refund for serious violations
• Report to competent authorities if necessary
• Legal action to protect our rights

6. User Content

The content you upload to Tabiquo ("User Content") remains your property. However, you grant us a limited license to:

• Store, process and display your User Content to provide the Service
• Perform backups and security copies
• Use metadata to improve the Service

You are responsible for your User Content and warrant that you have all necessary rights to upload it. We reserve the right to remove content that violates these terms.

7. Intellectual Property

Tabiquo and all its elements (design, code, logos, brands, content) are the property of Tabiquo or its licensors and are protected by copyright, trademarks and other intellectual property laws. You may not copy, modify, distribute or create derivative works without written authorization.

8. Service Availability

We strive to provide a reliable service, but we do not guarantee that Tabiquo will always be available, uninterrupted or error-free. We may temporarily interrupt the Service for maintenance, updates or technical issues. We are not responsible for losses arising from service interruptions.

9. Limitation of Liability

To the extent permitted by law, Tabiquo will not be liable for:

• Loss of data, profits or business opportunities
• Indirect, incidental or consequential damages
• Misuse of the Service by you or third parties
• User Content uploaded by you or other users

Our total liability will not exceed the amount paid in the last 12 months.

10. Indemnification

You agree to indemnify and hold Tabiquo harmless from any claim, loss or damage (including legal costs) arising from your use of the Service, breach of these terms or violation of third-party rights.

11. Cancellation and Suspension

We reserve the right to suspend or terminate your account if:

• You breach these Terms of Service
• You do not pay the applicable fees
• Your use of the Service causes damage or risk to other users

You can cancel your account at any time from settings. After cancellation, your data will be deleted within 90 days, except for legal obligations.

12. Modifications to Terms

We may modify these Terms of Service at any time. We will inform you of significant changes by email or by notification on the platform. Continued use of the Service after modifications constitutes acceptance of the new terms.

13. Governing Law and Jurisdiction

These Terms of Service are governed by Spanish law. Any dispute will be submitted to the exclusive jurisdiction of the courts of Valencia, Spain.

14. Miscellaneous Provisions

• Entire agreement: these terms constitute the entire agreement between you and Tabiquo
• Severability: if a clause is invalid, the others will remain in effect
• Waiver: failure to exercise a right does not imply waiver
• Assignment: you may not assign these terms without our written consent
